Handling Contract

In this document, "Handler" refers to Peter Kubacz and/or any person in their employ or serving as their agent. Every effort is made to contact Owner on the day of the show or at the end of the weekend. All dogs boarded for show purposes require at least a $1000 deposit, applied to final bill. Expenses for travel (including but not limited to; food, gas, lodging, parking, and assistants) are split among dogs being shown during that travel. Owner authorizes Handler to make show entries and obtain veterinary care using Owner's credit card. Owner is financially responsible for show entries and vet care arranged by Handler for Owner's dog. Owner shall supply Handler with updated veterinary records for dog; if not provided or if outdated, Handler may at his/her discretion obtain vet care to keep dog in good health and updated on vaccinations, etc. In case of emergency, Handler will attempt to contact Owner, but Handler is in all cases authorized to obtain emergency care as recommended by a vet of Handler's choice. For dogs that we are carrying every weekend, we do the entries. We do entries through "Infodog", or "entries-on-time" on owners credit card. If dog is entered and not shown due to inconvenience or personal reasons of Owner, Owner will be billed for the normal amount of that show and board. Handler shall use his/her discretion to select a qualified handler who shall take the dog in the ring if a conflict occurs. Handler has discretion to mark dog absent if Handler has a conflict or otherwise cannot show the dog. Owner shall pay bills promptly. Accounts must be paid in full when dog is returned to Owner. All accounts have a credit limit of $1,000. When that is reached it is Handler's discretion whether dog gets shown. Handler agrees to provide reasonable care and control for the dog, and to maintain sanitary and secure housing. Owner agrees to hold Handler harmless for any damage to the dog while in Handler's care, such as disease, theft, escape, or injury from other animals, unless such damage is caused by Handler's outright gross negligence. Owner agrees to indemnify Handler for any and all loss, damage, or liability caused by the dog while in Handler's care, custody or control. This includes but is not limited to injury inflicted by the dog on property, other animals, or on persons (including Handler). Handler is not legally liable or responsible to Owner or any other person for any damage caused by the dog, regardless of circumstance. Owner agrees to indemnify Handler for any damage caused by the dog. If Handler is constrained to turn an account over for collection or to enforce this agreement in court, Owner is responsible for all court costs, collection fees and/or legal fees. All client dogs that reside with Handler have priority over part-time dogs. Prize money awarded is property of handler. Rates are subject to increase on January 1 of each year.
